1. GENERAL AGREEMENT
This website is operated by the founder and store owner, Ieva Zarina, hereinafter – LULA, ensures the contents available on the website www.thelulawear.com, hereinafter –` Website/ Site, and provides services in accordance with the terms and conditions outlined below, delivery policy, returns policy, other terms and conditions, as well as the operational policy, description of which is posted on the Website with regard to certain functionality, features, or promotions as well as customer service, all of which are deemed to be part of and included within these terms and conditions (hereinafter collectively referred to as the Terms and Conditions). By authenticating to the ONLINE STORE section of the Website, you acknowledge that you have read, understood, and agree, without limitation or qualification, to be bound by these Terms and Conditions, which may include references to sustainable nursing outfits.

Where the consumer purchases products offered on LULA Website for sale, hereinafter – Goods/Products, via the Internet, such mutual agreement shall be deemed to be a Distance agreement and is subject to the provisions of the law of the Republic of Latvia governing the Distance agreement, including but not limited to the Republic of Latvia Act “Consumer Rights Protection Act”, Republic of Latvia Cabinet of Ministers Regulation “Regulation regarding the Distance Agreement”.

Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and services to you.

The Distances agreement for the purchase of the Goods shall be deemed to be concluded as of the time of payment for the Goods.

2. ONLINE STORE TERMS
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence and you have given us your consent to allow any of your minor dependents to use this site.

You may not use our goods, including sustainable nursing outfits, for any illegal or unauthorized purpose, nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws).

You must not transmit any worms or viruses or any code of a destructive nature.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer, including sustainable nursing clothes. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected. We attempt to be as accurate as possible when describing our products on the Site. If the product-related information (description, colors, etc.) has changed, LULA cannot guarantee that at any given moment data posted on the webpage contains all the latest updates. This site may contain certain historical information. Historical information, necessarily, is not current and is provided for your reference only. We reserve the right to modify the contents of this site at any time, but we have no obligation to update any information on our site. You agree that it is your responsibility to monitor changes to our site.

4. INTELLECTUAL PROPERTY
All information and content available on the Site, including but not limited to trademarks, logos, service marks, text, graphics, logos, button icons, images, audio clips, data compilations, and software, and the compilation and organization thereof (collectively, the "Content"), is the property of LULA. The customer may not change or remove any statement regarding copyrights, trademarks, or any other rights included in LULA’s products. This includes any materials related to our sustainable nursing clothes. The customer cannot sell, distribute, license, rent out, lease, lend, pledge, or in any other way assign or hand over these licenses and rights of use to any third party without the prior written consent of LULA. It is strictly prohibited to use, reproduce, copy, modify, publish, transmit, distribute, perform, display, download, license, enter into a database, create derivative works from, reverse engineer, frame, transfer, or sell any content obtained from, through, or on these services, in whole or in part.

5. PRICING POLICY
Prices on www.thelulawear.com are all in EUR. Prices for our products, including our breastfeeding clothing line, are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension, or discontinuance of the Service. All prices are subject to VAT tax or other sales taxes where applicable. Depending on the delivery destination, your order may be subject to additional shipping charges, which will be clearly indicated before you have to submit the payment and included in the total order cost. All duties and taxes required to be paid to receive the shipment in your delivery destination are to be paid by You. LULA is not required to inform you about any such duties or taxes at any time before or after you have placed an order on www.thelulawear.com.

6. ACCURACY OF BILLING AND ACCOUNT INFORMATION
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers, or distributors.

7. CONFIRMATION
By approving these terms and conditions and thereby confirming your order, this will serve as a binding agreement. When we have received your order, you will receive an automatic email confirming your order. We reserve the right not to deliver in the event that the stock level, including nursing-friendly clothing, was incorrect at the time of receiving the order. Should we be unable to deliver in accordance with the terms in the confirmation of order, we will contact you and give you the opportunity to cancel the order. 8. USER RESPONSIBILITIES
In the access or use of the Site, you shall comply with these Terms and Conditions and the special warnings or instructions for access or use posted on the Site. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments.

In matters not stipulated in these terms and conditions, the Buyer and the Seller undertake to comply with the laws and regulations in force in the Republic of Latvia. The Parties shall resolve all disputes between the Seller and the Buyer through mutual negotiations or correspondence. If the dispute is not resolved through negotiations or correspondence, the Parties will resolve the dispute in the court of the Republic of Latvia, in compliance with the laws and regulations of the Republic of Latvia. Disputes between the Buyer (consumer) and the Seller may be referred to the Consumer Rights Protection Center or the court of the Republic of Latvia. The Buyer also has the right to apply to the European Union's dispute resolution bodies.

13. FORCE MAJEURE
We have the right to assert force majeure in the case of war, warlike event, civil war, revolution, government sanction, strike, lockout, blockade, natural disaster, or similar circumstances. This means that the agreement will not need to be fulfilled in part or in full. In such situations, including unforeseen disruptions in our supply chain for breastfeeding wear, we will attempt to notify you as soon as possible.

14. POLICY CHANGES
LULA may periodically update these Terms and Conditions, including for new, unanticipated uses not previously disclosed. Any changes made will be posted here. By visiting and continuing to use the Website, you agree to accept any changes made to these Terms.
